The issues presented are: (1) under the instructions given the jury, the evidence is insufficient to sustain his conviction; (2) the district court did not properly have jurisdiction of the case, because the justice of the peace who conducted appellants preliminary hearing and bound him over to the district court for trial did not have evidence before him which established Sheridan County, Wyoming, as the place where the crime was committed; and (3) photographs of the assault and battery victim which depicted the injuries to his face and head were admitted without proper foundation.
